THESE TERMS AND CONDITIONS ARE SUBJECT TO CHANGE WITHOUT NOTICE.
Entity Definition
For the avoidance of doubt, all references to “Cork Lotus Yoga”, “we”, “us” or “our” in these Terms and Conditions shall be deemed to include Cork Lotus Yoga, its founders Hazel O’Sullivan and Katie Ahern, and any of their employees, contractors, agents, instructors or representatives.
References to “you”, “your” or “the User” refer to any person who accesses, browses or uses the Cork Lotus Yoga website, attends a class, purchases a subscription, attends a retreat, or otherwise engages with our services.
1. Liability Waiver
Participation at Your Own Risk
By signing up to, accessing or using Cork Lotus Yoga services — including but not limited to in-person yoga and Pilates classes at our Cork studio, outdoor classes in Clare, workshops, retreats, live online classes, pre-recorded online classes, and any other content or services provided — you acknowledge and agree that you are voluntarily participating in physical activity entirely at your own risk.
Health Acknowledgement
You affirm that you are in good physical condition and do not suffer from any known disability, injury, medical condition or health issue that would prevent or limit your participation in physical activities. This includes, but is not limited to, heart conditions, musculoskeletal injuries, high blood pressure, hypermobility and pregnancy-related conditions.
If you are pregnant, postnatal, menstruating, recovering from injury or surgery, or managing a chronic condition, you understand that participation in any movement programme presents unique risks. You confirm that you have consulted with your medical provider and have been cleared to participate in physical activity. You are solely responsible for monitoring your own health and well-being throughout your participation, informing the teacher of any relevant conditions before class, and modifying or stopping any practice that does not feel right in your body.
Waiver of Liability
To the fullest extent permitted by law, Cork Lotus Yoga, its instructors, employees, contractors, affiliates and licensors shall not be liable for any injury, illness, complications or damages arising from or related to your participation in any activities provided by us, whether in person or online. You expressly waive any and all claims against Cork Lotus Yoga for personal injury, illness, property damage, or any other loss incurred, except to the extent that such liability cannot be excluded under Irish law.
Assumption of Risk
You understand that engaging in physical activity carries inherent risks, including the risk of serious injury, and you voluntarily assume all such risks, whether known or unknown.
No Guarantee of Results
Outcomes from yoga, Pilates and movement practices vary for each individual. Cork Lotus Yoga makes no guarantees about the effectiveness or outcomes of any classes, programmes or advice provided.
Emergency Situations
You are responsible for ensuring your environment is safe for practice (particularly when joining classes from home) and for stopping any activity immediately if you feel pain, dizziness, shortness of breath, faintness, bleeding or any unusual discomfort. In case of an emergency, seek medical attention immediately.
2. Terms of Membership — Online Video Library
The Cork Lotus Yoga online Video Library is offered as a recurring subscription, billed by MemberPress and processed via Stripe.
Pricing & Trial
- Monthly: A 7-day free trial, after which membership rolls over to €19 per month.
- 6-Monthly: A 7-day free trial, after which membership rolls over to €119.94 every 6 months.
- Pricing may be updated from time to time; you will be notified in advance of any change to your active subscription.
Free Trial
The free trial is limited to one per customer. Multiple uses of the free-trial offer without prior written approval from Cork Lotus Yoga may result in the user being billed up to the value of the full membership price, with the full price being applied to the ongoing subscription at the relevant intervals.
Renewal
Membership subscriptions automatically renew at the end of each billing period, with charges automatically recurring for the duration of your subscription. Your subscription will continue to renew until you cancel.
Personal Use Only
Membership subscriptions and all content within are for private, personal use only. Login details must not be shared with or distributed to any third parties. Offenders may be held liable for loss of income or earnings, and we reserve the right to revoke or disable access to an account where abnormal activity is detected or these terms are breached.
Intellectual Property
Videos, images, audio and all written content on this website are subject to international copyright laws. All rights are reserved. No content may be copied, reproduced, redistributed, downloaded, screen-recorded, broadcast, or used for public or commercial purposes without our prior written permission.
Cancellation
You can cancel your subscription at any time through the membership portal. If you cancel before the end of the free trial, no charge will be made to your card.
To cancel:
- Log in to your account at www.corklotusyoga.com/login.
- Go to Account → Subscriptions.
- Click Cancel next to your active subscription.
- Confirm cancellation.
If you have an outstanding payment owing, you may be unable to cancel until your account is brought up to date.
If for any reason you are unable to cancel through the portal, please contact us at [email protected] and we will action the cancellation for you.
No refunds are offered for partial billing periods once payment has been taken, except where required by law (see Section 4 below).
3. Terms of Use — In-Person Classes, Drop-ins & Class Passes
Booking
In-person classes at the Cork studio and outdoor classes in Clare may be booked as drop-ins, class packs, or via subscription, depending on availability. Bookings are confirmed once payment has been received.
Cancellation & Late Arrival
- We ask that you cancel a booking at least 4 hours before the class start time to free your place for someone on the waitlist.
- Late cancellations or no-shows will be charged the full class fee or deducted from your class pack.
- For your safety and to minimise disruption, we may refuse entry to anyone arriving more than 10 minutes after the class start time.
Class Pack Expiry
Class packs are valid for the period stated at the time of purchase (typically 6 or 12 months). Unused classes will expire after this period and are non-refundable.
Code of Conduct
We are committed to maintaining a welcoming, inclusive and respectful environment for everyone. We reserve the right to refuse entry to, or remove, any person whose behaviour disrupts a class, the studio, or the well-being of teachers and other students.
4. Refund Policy
All sales of subscriptions, class passes, drop-in classes, workshops, courses and retreats are generally final and non-refundable, except in the following circumstances:
- Free-trial cancellations: If you cancel within the 7-day free trial, you will not be charged.
- Statutory rights: Where you have a statutory right of withdrawal under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, you may withdraw from a purchase of digital content within 14 days of purchase, provided you have not begun to access or stream the digital content. By starting to stream classes during this period, you expressly waive your right of withdrawal.
- Class cancellation by us: If we cancel an in-person class, workshop, course or event and are unable to offer a comparable rescheduled session, we will refund the relevant amount or, at your option, credit it against a future booking.
- Medical reasons: Refunds or credits for workshops and courses may be considered on a case-by-case basis where prevented by serious illness or injury supported by medical evidence.
Refund requests should be sent to [email protected] and will be processed within 14 working days where approved.
5. Terms & Conditions — Retreats, Workshops & Events
The following terms apply to any retreat, workshop, immersion, training or external event organised or hosted by Cork Lotus Yoga.
Booking & Deposits
- A non-refundable deposit is required to secure your booking at the rate specified at the time of registration.
- The remaining balance is due by the date specified on your booking confirmation.
- If you fail to pay the balance by the due date, we reserve the right to release your place and retain your deposit.
Shared Accommodation
If you book a shared room, you guarantee you are authorised to agree to these terms on behalf of your roommate. If your roommate cancels, you must either find a replacement roommate or pay the single-occupancy supplement, unless we are able to fill the place.
Cancellations by You
- Cancellations more than 60 days before the start date: deposit forfeited, balance refunded.
- Cancellations within 60 days of the start date: up to 75% of the total cost may be forfeited if the place cannot be resold.
- Cancellations within 14 days of the start date: 100% of the total cost may be forfeited.
We strongly recommend that you purchase travel and event insurance covering cancellation, curtailment, personal liability, medical expenses and loss of luggage.
Cancellations by Us
We may cancel a retreat or event at any time prior to commencement if, due to circumstances outside our reasonable control (including but not limited to global pandemics, natural disasters, political instability, transport disruption or insufficient bookings), it is no longer safe or viable to operate. In such circumstances we will offer either a transfer to an alternative date or a refund less any unrecoverable third-party costs (such as venue deposits, catering and non-refundable accommodation).
We are not responsible for any incidental expenses you may have incurred as a result of your booking, including but not limited to flights, transfers, visas, vaccinations, travel insurance excesses or pre-event accommodation.
Inclusions
Retreats and events are sold as a package. Opting out of individual sessions, meals or activities included in the package does not entitle you to a partial refund.
Indemnity
By booking a retreat or event with Cork Lotus Yoga, you agree to indemnify and hold Cork Lotus Yoga harmless against any claims or losses arising from your participation in the event, save to the extent caused by our negligence.
6. Terms of Use — General
It is recommended that you seek medical advice prior to commencing any new movement programme or yoga practice with Cork Lotus Yoga.
By using this website, you signify your consent to these Terms of Use. If you do not agree to them, please do not use the website.
Your access to and use of this website, as well as all related platforms operated by Cork Lotus Yoga (collectively the “Site”), is subject to the following terms and conditions and all applicable laws.
- Ownership of Content. You agree that the Site itself, as well as all content, videos, training materials, products, services and other materials made available on the Site by us or by third parties — including the look and feel of all of the foregoing (collectively the “Content”) — are maintained for your personal use and are the property of Cork Lotus Yoga and/or its third-party providers. The Content includes all proprietary videos, HTML/CSS, JavaScript, graphics, voice and sound recordings, artwork, photographs, documents and text. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access, view and use the Site solely for your personal, non-commercial purposes. No Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed or downloaded except with our prior written permission. Unauthorised use may be subject to damages and other legal remedies.
- Copyright. All Content, such as text, data, graphics, videos and sound files, is copyrighted unless otherwise noted and is the property of Cork Lotus Yoga and/or a supplier to Cork Lotus Yoga. No such materials may be used except as provided in these Terms.
- Trade Marks. All trade names, trademarks, logos, images and biographical information of people used in the Content — including without limitation the name and mark “Cork Lotus Yoga” — are the property of, or used with permission by, Cork Lotus Yoga. Any unauthorised use may violate copyright, trademark and other proprietary rights, as well as laws of privacy and publicity. If you believe your intellectual property rights are being violated, please contact us at [email protected] with details of the work in question, the alleged violation, registration information and any other relevant information.
- Accuracy. While we use reasonable efforts to include accurate and up-to-date information on the Site, we make no warranties or representations as to its accuracy. We assume no liability or responsibility for any errors or omissions.
- Electronic Communications. When you register with Cork Lotus Yoga, you expressly consent to receive notices, announcements, agreements, disclosures, reports, documents and other communications electronically — including transactional emails relating to your subscription, class bookings and account activity. You can manage your marketing email preferences as described in Section 7.
- Feedback. If you send comments or suggestions about the Site to us, such submissions become our sole property. No submission shall be subject to any obligation of confidence on our part, and we shall be entitled to unrestricted use, publication and dissemination for any purpose, commercial or otherwise, without any acknowledgement or compensation.
- Account Security. We use commercially reasonable efforts to restrict unauthorised access to our data and files. However, no system can be entirely impenetrable. You acknowledge that it may be possible for an unauthorised third party to access, view, copy, modify or distribute the data and files you store using the Site. Use of the Site is at your own risk. You are responsible for keeping your login credentials confidential and for any activity that occurs under your account.
- Privacy. We will not intentionally disclose personally identifying information about you to third parties, except where we, in good faith, believe such disclosure is necessary to comply with the law or enforce these Terms. By using the Site, you signify your acceptance of our Privacy Policy.
- Disclaimer of Warranties. TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER CORK LOTUS YOGA NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING OR MAINTAINING THE SITE SHALL BE LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO OR USE OF THE SITE. ALL CONTENT ON THE SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) THE IMPLIED WARRANTIES OF SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT USE OF THE MATERIALS WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE OR ITS CONTENT ARE FREE FROM BUGS, VIRUSES OR OTHER HARMFUL COMPONENTS. NOTHING IN THESE TERMS AFFECTS YOUR NON-EXCLUDABLE STATUTORY RIGHTS UNDER IRISH OR EU CONSUMER LAW.
- Third-Party Services. We are not responsible for any performance or service problems caused by any third-party website or service provider (including, for example, your internet service provider, Stripe payment services, your web browser, or any updates to such software). Any such problem shall be governed solely by the agreement between you and that provider.
- Limitation of Liability. IN NO EVENT SHALL CORK LOTUS YOGA BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, RELIANCE OR CONSEQUENTIAL DAMAGES — WHETHER FORESEEABLE OR NOT — INCLUDING (BUT NOT LIMITED TO) DAMAGE OR LOSS OF PROPERTY, EQUIPMENT, INFORMATION OR DATA, LOSS OF PROFITS, REVENUE OR GOODWILL, OR CLAIMS FOR SERVICE INTERRUPTIONS, OCCASIONED BY ANY DEFECT IN THE SITE OR ITS CONTENT, OR ANY OTHER CAUSE WHATSOEVER. THIS LIMITATION DOES NOT EXCLUDE OR LIMIT OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER IRISH LAW.
- Indemnity. You agree to indemnify and hold Cork Lotus Yoga and its directors, officers, employees and agents harmless from any and all liabilities, claims, damages and expenses, including reasonable legal fees, arising out of or relating to: (i) your breach of these Terms; (ii) any violation by you of law or the rights of any third party; (iii) any materials, information or content you post or share through the Site; (iv) your use of the Site or any of our services; and (v) your conduct in connection with the Site or with other users.
- Third-Party Beneficiaries. The provisions of these Terms are for the benefit of Cork Lotus Yoga and its affiliates, content providers and licensors, each of which shall have the right to assert and enforce such provisions directly or on its own behalf.
- Governing Law. These Terms shall be governed by and construed in accordance with the laws of Ireland, without giving effect to any principles of conflicts of law. You submit to the exclusive jurisdiction of the courts of Ireland to settle any dispute or claim arising out of or in connection with these Terms. If any provision of these Terms is held to be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
- Changes to These Terms. These Terms may be revised from time to time by updating this page. You are bound by any such revisions and should periodically visit this page to review the then-current Terms. Continued use of the Site after a change has been published constitutes acceptance of the revised Terms.
